Many tenants in Dubai think of subletting as a simple way to share costs or cover a rental while they are away. But subletting in Dubai is tightly regulated. Doing it without the right permission can put your tenancy, your deposit, and your relationship with your landlord at risk. This guide explains how it works, in plain language.
What Is Subletting in Dubai?
Subletting in Dubai means a tenant who holds a lease from the owner lets someone else use the property, either all of it or part of it, usually in exchange for rent. The original tenant stays responsible to the landlord under the main lease. The person who moves in, the subtenant, answers to the tenant.
Subletting is not the same as assigning a lease. In an assignment, the tenancy itself is transferred to someone else. In a sublease, the original tenant stays in place and signs a second agreement underneath the first. Subletting an apartment in Dubai is also different from running a holiday home, which is a separately licensed activity.
What Are the Rules for Subletting in Dubai?
The rule is simple: you cannot sublet without the landlord’s written consent, unless your tenancy contract already allows it. In short:
- Check what your tenancy contract says about subletting before you do anything else.
- If the contract is silent, the default position is that you may not sublet.
- Consent must be in writing, and it should cover the whole property or the specific part you plan to sublet.
- The sublease must stay consistent with the main tenancy contract.
A verbal “yes” from your landlord or agent is not enough. If a dispute arises later, what counts is whether written consent exists.
Is Landlord Consent Required for Subletting in Dubai?
Yes. Under Dubai’s tenancy law, written landlord consent is the core requirement for a lawful sublease. The only exception is where the original tenancy contract expressly allows subletting. In that case the permission is already in the contract, though it is still wise to confirm the details with the landlord.
In practice, written consent usually takes the form of a signed letter or No Objection Certificate (NOC). A good one names the tenant and the subtenant, states the property, and sets out the permitted period. Keep a signed, dated copy for the entire tenancy.
What Does Dubai Tenancy Law Say About Subletting?
The main source is Dubai Law No. 26 of 2007 regulating the relationship between landlords and tenants, as amended by Law No. 33 of 2008. Under Article 24, unless the parties agreed otherwise in the lease, the tenant may not assign the use of the property or sublet it to third parties without the landlord’s written consent.
The Dubai landlord and tenant law also treats unauthorized subletting as a ground for eviction before the lease ends (Article 25). The law covers subletting “the property or any part of it”, so renting out a single room falls under the same rule as renting out the whole unit.
A newer layer to know about: Dubai Law No. 4 of 2026 regulates shared housing and came into force on 26 August 2026. Under it, a property cannot be used as shared housing without a permit. Only the owner or an authorized establishment can lease out shared housing units, and tenants are not allowed to sublet them or any part of them. Existing owners and operators have a one-year transition period. If your plan involves renting out rooms or bed spaces, this law matters as much as the tenancy law.
What Are the Legal Consequences of Unauthorized Subletting in Dubai?
Subletting without written consent is a breach of the tenancy contract and of the law. The consequences can include:
- Eviction before the lease ends. The landlord can ask the Rental Disputes Centre to evict the tenant.
- Eviction of the subtenant too. The unauthorized occupant has no protected position against the landlord.
- Compensation claims. The subtenant keeps the right to claim compensation from the tenant who sublet to them, so the tenant can face financial exposure on both sides.
- Regulatory exposure. If the arrangement amounts to unpermitted shared housing, the shared housing law adds its own penalties, which increase for repeat violations.
- Disputes over the deposit and the tenancy record. A tenancy that ends in a dispute rarely ends cleanly.
What Are the Rights and Responsibilities of Tenants and Subtenants?
Tenant rights in Dubai include the right to peaceful use of the property and protection from eviction outside the grounds the law allows. When a tenant sublets, those rights come with duties.
The tenant (sublessor)
- Obtains written landlord consent before subletting.
- Remains liable to the landlord for rent and the condition of the property.
- Makes sure the sublease terms do not conflict with the main lease.
- Does not make changes, such as partitions, without the landlord’s permission and any required approvals.
The subtenant
- Pays rent to the tenant as agreed and uses the property only as permitted.
- Should ask to see the landlord’s written consent before signing or paying anything.
- Has a right to claim compensation from the tenant if the sublease was unauthorized and they are evicted.
The landlord
- Landlord rights in Dubai include approving or refusing a sublease and seeking eviction where subletting happens without approval. They must still follow the legal process, not take matters into their own hands.
A subtenant’s position depends on the main tenancy, so a subtenant should ask about the main lease’s term and status before committing.
Can a Landlord Evict a Tenant for Unauthorized Subletting?
Yes. A landlord can seek eviction before the lease expires if the tenant sublets the property, or any part of it, without written approval. But the landlord cannot simply remove the occupants.
The usual steps are:
- The landlord serves a formal notice on the tenant, through a Notary Public or by registered mail.
- If the issue is not resolved, the landlord files a case with the Rental Disputes Centre.
- The judge decides whether the ground for eviction is proven and orders eviction if it is.
Tenants who receive such a notice should not ignore it. Written consent given earlier, or a lease clause permitting subletting, can be a strong defense, so gather your documents quickly.
How to Sublet a Property Legally in Dubai
- Read your tenancy contract. Look for a subletting clause.
- Request written consent. Ask the landlord in writing and get a signed NOC that names the subtenant and the period.
- Check the shared housing rules. If you plan to rent out rooms or bed spaces, confirm whether Law No. 4 of 2026 applies and whether a permit is required. Tenants cannot sublet shared housing units.
- Write a clear sublease agreement. Include the parties, the property, the term, the rent, the payment method, and each side’s obligations. Attach the landlord’s consent.
- Keep the main tenancy in good standing. Make sure the original lease is registered and the rent is paid on time.
- Do not alter the unit. Adding partitions or extra rooms requires the landlord’s permission and any necessary approvals.
- Keep records. Store the consent, the sublease, and proof of payments.

FAQs
Is subletting legal in Dubai?
Yes, but only with the landlord’s written consent, unless your tenancy contract already permits it. Subletting without it breaches the law and can lead to eviction.
Can I sublet just one room in my apartment?
Yes, but the same rule applies. Subletting any part of the property requires written landlord consent. Since the shared housing law took effect, renting out rooms or bed spaces may also raise permit issues.
Is verbal permission from my landlord enough?
No. The law requires written consent. Verbal approval is hard to prove in a dispute.
What happens to the subtenant if the tenant is evicted?
In an unauthorized sublease, the subtenant can also be evicted, but keeps the right to claim compensation from the tenant who sublet to them.
Where are subletting disputes heard?
Tenancy disputes in Dubai are heard by the Rental Disputes Centre. Disputes under the shared housing law are also directed there.
Do I need a lawyer to sublet?
Not always, but legal review of the consent and the sublease agreement helps you avoid costly disputes.
